Pakistan’s Supreme Court has turned down yet another attempt to speed up proceedings in the Imran Khan hospital case, rejecting a request from the jailed former prime minister’s sister for an earlier contempt hearing. The court’s registrar office said the case will stay on its existing schedule regardless of the request.

Dr Uzma Khan had asked the court to expedite contempt of court proceedings against government functionaries accused of violating an August 18 order that directed Imran Khan’s transfer to Shifa International Hospital for medical treatment. The Imran Khan hospital case, along with related pleas concerning his health and family visitation rights, is now fixed to resume on September 16 before a three-judge bench.

Why the Court Keeps Declining an Early Hearing

Court officials have consistently maintained that granting exceptions to the fixation policy for one case risks opening the door to similar requests from litigants in dozens of other pending matters, a precedent the registrar’s office says it is unwilling to set regardless of how high-profile the underlying case may be.

The bench, comprising Justice Shahid Waheed, Justice Naeem Akhtar Afghan and Justice Ishtiaq Ibrahim, last addressed the matter on August 18, when it ordered Imran’s transfer to the private hospital within two days. Since then, Uzma Khan’s team has twice sought to move up the contempt hearing, arguing that swift action is needed to ensure the original order is actually being enforced.

Both requests have been rejected on the same procedural grounds: the SC’s fixation policy requires cases to be heard in the order they were filed, and officials point out that 94 separate criminal original petitions in the same category are already waiting their turn. Advocate Uzair Karamat Bhandari, representing Uzma Khan, argued in the second application that early hearing would serve the interest of justice given the urgency of enforcing a court order tied to a prisoner’s medical care.

The Imran Khan Hospital Case Draws National Attention

The case has drawn intense public attention since it touches on both the ongoing legal battles facing the PTI founder and broader questions about how strictly government functionaries are held to court orders. Supporters of Imran Khan argue that the repeated delays undermine the credibility of the original August 18 ruling, while officials maintain that procedural fairness requires all similarly situated cases to be treated the same way.

Government lawyers have avoided commenting publicly on the substance of the contempt allegations, sticking closely to procedural arguments about case-fixation order rather than addressing whether the underlying August 18 directive was in fact violated as Uzma Khan’s team alleges.

Legal commentators note that the fixation policy, while procedurally consistent, has drawn criticism in politically sensitive cases where delays can carry outsized consequences, particularly when a person’s medical treatment is directly tied to the outcome.

What Happens on September 16

Political analysts note that however the bench ultimately rules, the case will likely remain a flashpoint in the broader standoff between Imran Khan’s supporters and the current government, with each procedural development scrutinized closely by both sides for signs of favor or obstruction.

When the bench reconvenes, it is expected to address both the contempt petition and the broader set of pending pleas concerning Imran Khan’s health and family meetings together, rather than in separate, staggered hearings. Whether that combined session produces a definitive ruling on the contempt question remains to be seen.

As Dawn reported, Uzma Khan’s legal team has signaled it may continue pressing for faster action even as the case moves toward its scheduled September date.
